Minutes
Monday June 8, 2009

BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION ON JUNE 8, 2009 WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: CHRIS MITCHELL, TOMMY MARINER, LOY JOHNSON, JOY WILSON AND JACK BLACK.

HEAR THE PUBLIC

Phyllis Helton stated concerns with preserving the historic aspect of living in the City of Norris. Kathy Sarvis stated concerns with the completion of the Public Safety addition and if the floor has rebar in it. Public Works Director Shirley Walker stated there is rebar in the floor. City Manager Hester said everything is complete and looks great. George Miceli stated need to look at putting the Fence Ordinance aside and look at the big picture.

MINUTES

1. Council Member Tommy Mariner moved to approve the minutes with omitting the exclamation points. Seconded by Council Member Jack Black. Motion carried by voice vote.

OLD BUSINESS

Update by City Manager Hester on Public Safety addition. The Shingle working is complete. Special thanks to Steve Byrne and Byrne Woodworks Company. Update by City Manager Hester on Sign ordinance – guidelines on elected official signs – Rogers is political issue but not tied to an election. Sign ordinance states that 30‐day before an event and 30 day after event that the temporary sign can be up. Also, the sign ordinance states that signs displayed prior to the sign ordinance passage in 2008 were allowed as special exceptions: signs such as the Rogers signs could stay up, but could not be replaced.

Discuss and ratify/approve new members list by Mayor Mitchell to nominate Susan Miceli for Recycling Committee. Ms. Miceli approved by voice consent. Ethics Policy update by City Manager Hester.

2. Council Member Jack Black makes motion to amend policy as written (see attached). Seconded by Council Member Chris Mitchell. Voting Aye: Jack Black, Chris Mitchell, Loy Johnson, and Joy Wilson. No: Tommy Mariner. Motion carried.

Final reading on the Fence Ordinance 503.

General discussion held on the fence ordinance and whether or not that limiting the height of fencing in front yards adequately addressed citizen conerns.

3. Council Member Tommy Mariner moves to table the Fence Ordinance 503 until further review. Seconded by Council Member Jack Black. Motion carried by voice vote.

Final reading on the Budget Ordinance 504.

Council Member Johnson is concerned with the 1.5 percent salary raise being conditional, not a good idea to lower taxes at this time. She believes that our tax money is well spent. Council Member Wilson stated concerns with the economies down fall ‐ economic environment is not getting any better. Holding the 1.5 percent salary raise sends a negative message to our employees. Council Member Black is concerned with employees being affected.

Council Member Mariner would like to see that the Whereas statement be taken out. Council Member Mitchell’s view is that if we give the 1.5 percent to the employees, we must clearly understand that if revenue does not come in as projected and we get stressed, we won’t have the built in measure of flexibility that is what is being taken away.

4. Council Member Loy Johnson makes motion to amend Budget Ordinance 504 to keep property tax at 1.98 and take out the Whereas statement, give employees 1.5 percent at beginning of the 2009 – 2010 Fiscal Year. Seconded by Council Member Jack Black. Voting aye: Joy Wilson, Loy Johnson, and Jack Black. No: Chris Mitchell and Tommy Mariner. Motion Passes.

CITY MANAGER REPORT

Update on paving project on West Norris Road: Paving behind schedule due to weather. Tentatively scheduled for week of June 8.

Recognized Dean Harshbarger for 35 years of service to the Norris Water Commission.

Norris Woman’s Club donated Projection screen to the City of Norris.

Recognizing the Certificate of Achievement for Excellence in Financial Reporting from the GFOA.

Changes on parking and traffic on Ridgeway at Camelot. Creating a 3 way traffic stop reduce speed to 15mph. Reduced parking in front of Ridgeway.

Overview of the Water Commission 2009 ‐2010 Fiscal Year Budget.

Looking at changes to the telephone services to Comcast. Everyone says stay with current service.

5. Council Member Tommy Mariner moves the following appropriations in the 110 General Funds. Seconded by Council Member Joy Wilson. Motion carried by voice vote.

Increase Revenue Code:  110‐33490 Tennessee Housing Agency $170,802.79

Increase Code:  110‐27200 Designated for Local Gov Hware/Sware $2,778.27

Decrease Expenditure Code:  110‐41000‐948 Computer Equipment $2,778.27

Increase Code:  110‐27210 Designated for TDOT Grant $66,843.00

Decrease Revenue Code:  110‐33430 TDOT Enhancement Grant $66,843.00

Increase Revenue Code:  110‐36720 Public Safety Donations $289.00

Increase Expenditure Code:  110‐42200‐929 Other Buildings/Addition $289.00

NEW BUSINESS

Scenic Highway Zoning designation Ordinance 505 1st reading.

6. Council Member Tommy Mariner moves to except as written Ordinance 505. Seconded by Council Member Jack Black. Voting aye : Tommy Mariner, Jack Black, Joy Wilson, and Chris Mitchell. No: Loy Johnson. Motion passes.

7. Council Member Tommy Mariner moves to schedule a public hearing July 13th 6pm. Seconded by Council Member Joy Wilson. Motion carried by voice vote.

Discussion on plan of services for annexation. Consider scheduling of Public Hearing for annexation and plan of services.

8. Council Member Tommy Mariner moves to schedule a public hearing August 10th 6pm. Seconded by Council Member Jack Black. Motion carried by voice vote.

Minutes and Reports

Council Member Johnson would like to see speeding tickets put back in the Public Safety Report.

New Business

Mayor Mitchell is proposing to do volunteer work at the local businesses around town for increase in business.

Mayor Mitchell would like for community development to take action on purchasing a basket ball goal for gym and check on stands for people to sit on.

9. Council Member Tommy Mariner moved to adjourn. Seconded by Council Member Loy Johnson. Motion carried by voice vote. 9:20pm
