Norris City Council Minutes,Monday June 14, 2010 BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION
ON JUNE 14, 2010 WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: JACK BLACK, LOY JOHNSON, TOMMY MARINER, AND CHRIS
MITCHELL. NOT PRESENT: JOY WILSON. HEAR
THE PUBLICAl Fletcher has concerns with neighboring
property owners near the Little Senator Drive making it difficult for Buffalo Creek to get any business because of the personal
property that is blocking the roadway. Mr. Fletcher understands that the neighboring property is
a growing business but his is as well and would like some help dealing with the parked vehicles. Public
Safety responds accordingly to all calls but he has been told that this is a civil matter and cannot handle this issue.
Al Fletcher would like for the city to recognize that this street is in the city and not owned by DOT right way, enforce
parking regulations in the area, and have a valid City of Norris address. Per the request of City Council, City Manager Hester will research and clarify with TDOT where
the right way is located. MINUTES 2. Council Member Loy Johnson moved to approve the Council Minutes
from April 12, 2010 as written with one modification. Seconded by Council Member Tommy Mariner.
Motion carried by voice vote. OLD BUSINESSCouncil
Member Tommy Mariner presented an overview of the Tax Assessments. The assessment went up about 30%.
The city will off set that by adjusting the tax rate. If you have any questions pertaining to the
tax assessment call the county property Assessors office. This is who handles the assessment rates
along with the State. The Assessors office has an appeal process that you can use if necessary.
The appeal process ended 1st of June. The reasoning why the assessment value went up
30% and making this higher than other surrounding cities is because of the values has continued to go up in reflected value
of sales. 2. Council Member Tommy Mariner makes a motion to accept the 2nd
reading on Ordinance 517 Utilities and services, chapter two, Water and Sewer service, Section 18-208, schedule of charges
for Water and Sewer service, Section 18-208, schedule of charges for water and Sewer services. Seconded
by Council Member Jack Black. Motion carried by voice vote. 3. Council Member Tommy Mariner makes a motion to accept the 2nd
reading on Ordinance 518 FY 2010-2011 Budget with certified tax rate of $1.55. Seconded by Council Member
Loy Johnson. Motion carried by voice vote. CITY MANAGER REPORT Year to date budget.
Property Tax Collections are on target. State Sales Tax and Local Option Sales Tax continue to run
below budget, and Expenditures are in line to budget to date. Expenditures are in line to budget to date,
except for $7k expenditure to repair the Ford dump truck. This expense was offset by savings on City liability
insurance. EECBG update. The
Energy Policy Office is in the final stages of getting the contracts out to the communities. They plan
to email them out in the next few weeks. Once this is done, projects can commence. 2009 TIBRS report stats the City of Norris as having one of the lowest crime
rates in East Tennessee. Thanks to everyone that makes a safe community. City County Election reports that first day to pick up petitions was May 21st
and the last qualifying deadline date is Thursday August 19th by Noon. TEA-21 Sidewalk Grant has been under review by TDOT and will soon be approved
to bid the project. The project is on schedule to be completed late this summer. Home Grant update. Awards for the 2010 Home Grant have been announced. Norris
has not been awarded a grant for this year. Paperwork has been submitted to officially close the 2007 grant.
A total of $365,421.04 was spent to remodel and/or replace homes in Norris on the 2007 grant. Workshop July 1st at 7pm, on speed cushions/striping/paving Annexation update. An annexation complaint was filed by legal representation for Tennessee
Quality Investments, Inc., owners of the Anderson Crossing Shopping Center and Anderson Crossing Storage facilities.
The complaint “avers that the annexation of its property may not reasonably be deemed necessary for the welfare
of the residents and property owners of the affected territory and the municipality as a whole and so constitutes an exercise
of power exceeding that conferred by law,” and avers that there is “no logical reason or rationale for other properties
excluded by the annexation.” The Court
date is scheduled for Friday July 16, 2010, 9am at the Anderson County Circuit Court. NEW BUSINESS BUDGET AMENDMENTS 4. Council Member Jack Black moves the following appropriations in the 110
General Funds. Seconded by Council Member Tommy Mariner. Motion carried by voice vote. Increase Expenditure Code:110-41000-791

$ 7,413.00 City Manager Hester would like to recommend to council TML’s letter of consideration.
Defibrillators must be registered with the local emergency response team and users of the defibrillator must be certified
by the American Heart Association or equivalent in defibrillator use and cardiopulmonary resuscitation (T.C.A 68-140-703).
Discussion was made and various suggestions were mentioned. 5.
Council Member Tommy Mariner makes a motion to buy two defibrillators, one to place in public safety building and one
at the City Community building. Seconded by Council Member Jack Black. Motion carried
by voice vote. 6. Council Member makes a motion to accept first reading on Ordinance 519
amending title 15, motor vehicles, traffic and parking, chapter 3, speed limits, section 15-303 in school zones of the City
of Norris. Seconded by Council Member Loy Johnson. Motion carried by voice vote. 7. Council Member Tommy Mariner moved to adjourn. Seconded by Council
